Nakheel told evidence in ex-CEO lawsuit is sufficient

The Dubai World Special Tribunal has rejected a request by property developer Nakheel to send a case filed by its former CEO to full trial.

Judge Anthony Evans said Nakheel cannot present further evidence on the performance of former chief executive Chris O’Donnell as there was no material dispute over facts already presented by both parties.

O'Donnell filed a breach of contract lawsuit against the developer last July, seeking $3.7 million in unpaid dues.

O’Donnell, who joined the company in 2006, stepped down from his post in early June and Nakheel said in a statement confirming his departure in June 8 that he had left the company “after completing his contract terms.”

According to the case documents, the developer said O’Donnell is not entitled to long-term incentives, as he has not applied for some of them within the designated time period and he resigned a week before the end of his five-year contract.

O’Donnell rejects the claim.

The Dubai World Tribunal is a special judicial body set up in the Dubai International Financial Centre (DIFC) to handle claims involving the settlement of the financial position of Dubai World and its subsidiaries.

In August, Nakheel completed its financial restructuring and separated from its parent company as part of the deal.
